“Red Hat regards this most recent announcement with a healthy dose of skepticism,” he wrote on his blog. He called on Microsoft to make three commitments: embrace the Open Document Format and cease pushing OOXML; extend its Open Specification Promise (which offers some web services protocols royalty free) to all the APIs and protocols it plans to document; and waive the stipulation that open source implementations can be for non-commercial products only. Microsoft drew a clear distinction between noncommercial and commercial use of technology for which it holds patents. Brad Smith, senior vice president and general counsel for legal and corporate affairs, said those who want commercial distribution would need a patent licence.
