"At the end of last month, a court in Mannheim agreed that Taiwan's HTC Corporation had infringed IP-Com patents. If HTC cannot now come to an agreement with the IP-Com or fails in an appeal, it faces the imposition of an injunction that would prevent distribution of its products in Germany. Bearing in mind the size of the German market, that is a pretty powerful negotiating weapon that IP-Com has acquired. As I wrote at the time the Nokia case came to light, litigation comes relatively cheap in Germany and injunctions are widely available - probably more so than in the US in this post eBay world. Combine those two things and you have an environment in which certain types of troll/NPE can thrive."
