From a global competition perspective, other nations and regions are evaluating the patentability of software, which places the United States in the spotlight in terms of its efforts to recognize and award innovation in a rapidly growing industry. For example, in March of 2008, the president of the European Patent Office forwarded a series of questions regarding patentability of software-related inventions to the Enlarged Board of Appeal for the European Patent Office for reconsideration.7 Given the significant investment that Europe has made in the global software industry, second only to the United States, it is likely that Europe will be affected by the United States' actions with regard to the patent eligibility of software (i.e., process-related inventions).
