The EPO is organising a conference in Brussels on the thursday 5th July, the day before the anniversary of the rejection of the directive, which was aimed to codify the EPO caselaw and practice in the acquis communautaire of the European Communities.

The conference aims to raise several questions such as "How have the EPO's practice and case law evolved?".

The schedule of the conference does not seem to integrate the link between the EPLA and the rejection of the directive, where some people suspects that the Commission relaunched the debate on the Community Patent in order to get the same, or even worse, result as the original goal of the directive, by another path.

Background:

Two years ago, the European Parliament (EP) rejected the directive proposed by the European Commission on the patenting of so-called computer-implemented inventions. The number of patent applications relating to computers, telecommunications and electronic media - the product areas with which most of these inventions are associated - continues to grow. So does the number of grant procedures handled by national patent offices and the EPO and, as a consequence, the number of appeals before national courts and the EPO's technical boards of appeal. Since the directive was rejected, some of these cases have also led to public discussion about where we go from here.

This is the background to the EPO's conference, which it hopes will contribute to an informed debate on the issue. What has happened in patenting practice since July 2005? How have the EPO's practice and case law evolved? In what ways are users of the system affected by the absence of the directive? What about the concerns over patent quality voiced by critics and users alike?

Participants and target audience:

The conference brings together speakers from EU institutions, the EPO, national patent offices, national courts, representatives of industry, patent attorneys and lobbyists.

It addresses European policymakers (members of parliament, representatives of EU institutions), special interest groups, chambers of commerce, patent specialists, and journalists with an interest in patent matters.

Structure:

The conference is chaired by Oswald Schröder, Principal Director, Head of Communications at the EPO

Moderated by James Nurton, editor-in-chief of the magazine Managing Intellectual Property, four different panels will seek to explore these topics from different perspectives.
