Clive Menezes, a patent attorney with Halliburton, of Dick Chaney fame, has filed for patent protection for a method of "patent acquisition and assertion by a (non-inventor) first party against a second party." The process he describes involves obtaining an interest in a patent, writing a claim broad enough to cover the second party's product, filing the claim, and then suing the second party for infringement. The Federal Circuit's recent Bilski decision, however, may make it difficult for Menezes to actually get a patent. Bilski holds that business method patents must be related to a machine and produce a transformation.
