On Monday, June 1, 2009, the United States Supreme Court granted cert. in Bilski v. Doll. This means that the last chapter on business methods and software has not yet been written, which could be good news or bad news depending upon your particular take. What is certain, however, is that the same Supreme Court [...] will dip its toe into the business method and software debate.

A brief summary of how a programmer became attorney just to introduce software patents to the US and give programmers the protection he claims they deserve. (Does this sound like the shopkeeper becoming a mobster to give shopkeeprs the protection they need?)

Bergelt's statement attracted a swift response from Gutierrez, who is vice-president for IP and Licensing at Microsoft. He said: "The terms of the contract are confidential and therefore we cannot comment on the amount of the settlement payment. However, Mr Bergelt is wrong. Mr Bergelt’s speculation is based on an incorrect understanding of Dutch law and therefore cannot be relied upon as a basis for interpreting the amount of the settlement payment to Microsoft. If people would like to know the real financial terms of the agreement, Microsoft has no objection to that if TomTom wishes to waive the confidentiality of those terms."

According to a leaked document authored by the European Commission DG Trade, the secret ACTA treaty will reopen the debate on the liabilities of Internet Service Providers (ISPs) over content, as well as trying to achieve criminal sanctions in the EU under the French Presidency Sarkozy.

Tax stategy patents are unwise as a matter of policy. Taxpayers shouldn't have to worry about having to contest a royalty claim if their tax information becomes public in a Tax Court case.

The ACTA treaty is currently negotiated between US, Europe, Japan and other developed nations. According to leaked information, the treaty would apply the same harsh sanctions for all IP infringements, whether they are patents or plant variety rights. ACTA might be a fuel for trolls, since it could lower down the threshold level for obtaining injunctions and preventive freezing bank accounts of the suspected infringer.
